Did you know that if your flight is delayed, you are entitled to compensation of up to EUR 600 / USD 654 / GBP 515 up to 3 years in arrears? And that you are entitled to a discount if you don't get what the travel agent promised to you? This also applies to a dirty pool, insects in the room or poor quality food. Simply put, if what you were promised at the beginning is not kept. Together we will look at what you are entitled to and how to resolve it if necessary.

Vacation complaints

If the room or anything else is not to your liking, please do not hesitate to contact reception or your delegate. A lot of problems can arise from simple misunderstandings or are not difficult to rectify. You also need to base it on what you have purchased - if you are holidaying in a 2 star hotel, you can demand cleanliness and working facilities, but not your own butler :).

However, it may happen sometimes that a travel agency buys inferior rooms at a better price and expects to get away with it with clients. However, if a similar situation has already happened, it's best not to let it go and address it with a request for a discount on the holiday because it didn't match what you bought.

What can you claim?

  • Different hotel. Spoiled or inedible food.
  • Lower number of stars. Missing or dirty pool. Mould and insects in the room
  • Lack of facilities.
  • Failure to comply with All Inclusive.
  • Dirty beach, noise, smell, etc.

You have the right to make a claim within 30 days of the end of the tour. It is important to document the problem as closely as possible, take photos/recordings and then contact the travel agency with your claim. If they do not comply, you can contact Claimcloud. The way it works is that you don't pay them anything for the service, they only take a percentage of possible claim. That way you don't risk anything.

In any case, don't hesitate to make a claim and insist on your rights. It will only help to improve the quality of tourism services.

Air travel complaints

The entitlements are based on regulations of the European Parliament and the Council of the EU and apply to all citizens of the European Union and to all flights. So even if you buy tickets from Wroclaw to Warsaw for EUR 6.2 / USD 6.8 / GBP 5.3 and the flight is significantly delayed due to the carrier, you are entitled to compensation of EUR 250.

You have to ask for compensation - the airline will rarely give you compensation on its own and I myself have not come across it yet. It's mostly low budget airlines that will often not grant your request for compensation and they will rely on you not taking it to court. Delayed flight

Was your flight delayed by three hours or more? Under EU regulations, you are entitled to financial compensation.

  • EUR 250 / USD 272 / GBP 215 if the flight is delayed by 3 hours or more and the flight is less than 1500 km
  • EUR 400 / USD 436 / GBP 344 if the flight is delayed by 3 hours or more and the flight is between 1500 and 3500 km long
  • EUR 600 / USD 654 / GBP 515 if the flight is delayed by 3 hours or more and the length of the flight is more than 3500 km

The right to financial compensation under EU law ceases in the event of so-called extraordinary circumstances, such as bad weather, a strike at the airport, a riot at the final destination or a collision with a bird. WARNING: Beware of excuses from airlines, which often deliberately misstate the status of an emergency so that they do not have to compensate passengers.

In addition, you are entitled to free refreshments for delays of more than two hours.

Cancelled flight

If your flight is cancelled, you are entitled not only to a refund of your ticket but also to financial compensation under EU regulations.

  • EUR 250 / USD 272 / GBP 215 for flights up to 1,500 km
  • EUR 400 / USD 436 / GBP 344 for an EU flight of 1,500 km or more, or a non-EU flight of 1,500 - 3,500 km
  • EUR 600 / USD 654 / GBP 515 for flights of 3,500 km or more

Denied boarding

If you are denied boarding against your will, you are entitled to financial compensation in accordance with European Union regulations.

  • EUR 250 / USD 272 / GBP 215 for flights up to 1,500 km
  • EUR 400 / USD 436 / GBP 344 for an EU flight of 1,500 km or more, or a non-EU flight of 1,500 - 3,500 km
  • EUR 600 / USD 654 / GBP 515 for flights of 3,500 km or more

The airline is also obliged to refund you for the tickets.

Diverting a flight to another airport

If your flight has been diverted to another airport, the air carrier will be liable for the costs incurred in transportation to your original point of arrival.

If you get information of the diversion before boarding, you have the right to refuse the flight and claim a refund from the carrier.

Lost or damaged luggage

If your luggage is lost or damaged by the airline, they are obliged to compensate you for the damage. The maximum amount you can claim from the airline is EUR 1220 / USD 1330 / GBP 1050 per bag.

WARNING: The situation must be addressed immediately at the airport and, within 7 days, a written request for compensation must be submitted to the airline.
